General Terms and Conditions of Sale
Article 1 - Subject
1.1 These general terms and conditions of sale apply to any stay sold by the company HDP (hereinafter “the Company”, TCR MONTPELLIER n°519 197 628) and booked by telephone or online on the following website:
1.2 Two types of accommodation are offered by the Company:
- The Hôtel de Paris, a three-star hotel in SETE (34)
- Le Moulin, furnished tourist accommodation in FONTES (34)
The Company directly operates the Hôtel de Paris and markets the accommodation of Le Moulin on behalf of the company SUD FINANCE (TCR MONTPELLIER n°348 920 281).
Article 2 - Booking
2.1 The confirmation of the order implies the acceptance of these terms and conditions of sale and the acknowledgement that they have been perfectly understood. The confirmation of all data and records provided will constitute proof of the transaction. The confirmation will be considered equivalent to a signature and acceptance of the operations carried out.
2.2 The booking takes effect as soon as the Customer has confirmed it online or by telephone and as soon as it has been secured with a valid debit or credit card on the date of the beginning of the stay. The Company sends the order confirmation to the Customer by email.
2.3 The right of withdrawal is not applicable to hotel services.
Article 3 - Length of stay
The Customer, the signatory of a contract which is entered into for a determined duration, will not, under any circumstances, be able to invoke any right to remain beyond the initial duration in the rooms of Hôtel de Paris or in the furnished accommodation of Le Moulin.
Article 4 - Cancellation by the Customer
4.1 HÔTEL DE PARIS
The rate charged in the event of a cancellation depends on the rate chosen by the Customer.
Standard rate
A valid debit or credit card will be required as a guarantee; this is obligatory.
- In the event of a cancelled or modified booking by the Customer 24 hours before the arrival date, no fee will be charged.
- In the event of a late modification or a no-show, the Company will charge the total amount of the stay.
- In the event of a shortened stay, the Company will charge the total amount of the stay.
Non-cancellable/non-refundable/non-modifiable rate
Prepayment is required in its entirety when the booking is made by debit or credit card (distance selling); there is no option for a refund for whatever reason, including illness.
4.2 LE MOULIN
- Full refund for cancellations made within 48 hours of booking, if the arrival date is within 14 or more days.
- 50% refund for cancellations made at least 7 days of the arrival date.
- No refunds for cancellations made within 7 days of the arrival date.
Article 5 - Arrival/Departure
5.1 HÔTEL DE PARIS
The Customer can arrive on the specified day from 3 p.m. and can use his/her room until midday on the day of departure.
In the event of late arrival (after 11 p.m.), the Customer must inform the Company.
5.2 LE MOULIN
The Customer can arrive on the specified day between 5 p.m. and 7 p.m. The accommodation must be vacated by 10 a.m. at the latest on the day of departure.
In the event of late arrival (after 7 p.m.), the Customer must inform the Company.
Article 6 - Regulations
The prices are in euros. VAT is included in the stated price. Any change made by the competent authority to the applicable tax rates or any modification or introduction of new laws and taxes will be reflected automatically in the prices displayed on the date of invoicing.
6.1 HÔTEL DE PARIS
The Company accepts payments in cash, by credit or debit card, AMEX card and ANCV cheques.
6.2 LE MOULIN
Stays must be paid for online or by telephone, by means of distance selling, by contacting the reception at the Hôtel de Paris. The Company accepts payments by credit or debit card and AMEX card.
Article 7 - Tourist tax
The tourist tax is a local tax that the Customer must pay to the Company which then transfers it to the French Public Treasury.
The total amount of this tax is stated when paying for an online booking or at the beginning of the stay.
Article 8 - Use of the premises
8.1 The Customer must respect the peaceful nature of the premises and use them in accordance with their purpose. The Customer agrees to leave the accommodation in perfect condition.
Events and parties are not allowed. The accommodation of Le Moulin and the rooms of the Hôtel de Paris are non-smoking.
8.2 Individual inventory at Le Moulin
When taking possession of the accommodation of Le Moulin, a deposit of 1,500 euros will be required to cover any damage to the rented property or to any items and to compensate for any lack of maintenance of the premises at the end of the rental period. This deposit will be returned, after deductions are made for any damage, negligence and cleaning costs.
On the day of arrival, it is the Customer’s responsibility to carry out an inventory of the premises and to report any anomalies to the staff by 11 a.m. on the day after the Customer takes possession of the accommodation of Le Moulin. On the day of departure, an inventory of the premises is carried out and the deposit is returned immediately if no damage to the property or equipment is observed and no need for cleaning is identified.
Article 9 - Animals
9.1 The Customer can stay at the Hôtel de Paris with a pet, upon request. The Company may, however, refuse to accept animals. Under no circumstances can this refusal be considered to be a modification or breach of contract by the Company; as such, in the event of the Customer’s departure as a result, the total amount of the stay will be retained by the Company. An additional cost of €10 will be charged per animal and per night.
9.2 Animals are not allowed in the furnished accommodation of Le Moulin.
Article 10 - Capacity
The contract is entered into for a specific number of people. If the number of Customers exceeds this number, the Company and its staff are entitled to refuse additional Customers. Under no circumstances can this refusal be considered to be a modification or breach of contract by the Company; as such, in the event of the departure of a number of Customers higher than those refused, the total amount of the stay will be retained by the Company.
Article 11 - Insurance
The Customer is responsible for all physical or material damage which he/she causes. He/she must therefore check whether his/her home insurance also includes coverage when on holiday (for holiday rentals). The renter certifies that he/she has a civil liability insurance policy covering his/her own liability and that of the persons accompanying him/her.
Article 12 - Disputes
12.1 It is recommended that the Customer contacts the Tourist Office, which will act as a mediator to encourage the amicable settlement of disputes.
12.2 For any disputes arising from the execution or the interruption of this contract, only the Courts of the place in which the accommodation is located shall have jurisdiction.
Article 13 – Photographs
The photos shown on the Company’s website when booking are not contractual. Rooms at the Hôtel de Paris are assigned randomly, subject to availability, depending on the category booked.
